Emergency Motions in Florida Family Court — What Qualifies and How They Work
Florida family judges can act immediately, sometimes without hearing from the other side first, when a child faces an imminent risk of harm. That power is used sparingly. Most of what feels urgent to a parent does not meet the legal standard, and a motion labelled emergency that is not one damages credibility for the rest of the case. This guide explains what Florida courts treat as a genuine emergency, what happens procedurally, and what the realistic alternatives are.

The short answer
A Florida family court will consider emergency relief when sworn, specific facts show a child is in imminent danger of physical harm or of removal from the state or the country. The motion must be verified — sworn to under penalty of perjury — and must state facts, not conclusions. Relief granted without notice to the other parent is temporary by design and is followed quickly by a full hearing.
What Florida courts treat as a genuine emergency
The recurring categories are narrow and serious:
- A credible, imminent threat of physical harm or abuse to the child
- A parent's substance use or untreated mental health crisis that leaves a child unsupervised or unsafe right now
- Concrete indications a parent is about to remove the child from Florida or from the United States — packed bags, sold house, one-way tickets, a passport application
- A child already wrongfully withheld or taken in violation of an existing order
- Exposure to domestic violence in the home
What usually is not an emergency
Courts routinely decline to treat these as emergencies, even when they matter: a missed or shortened timesharing exchange, disagreement about a school, a new partner the other parent dislikes, poor hygiene or an untidy home, a parent speaking badly about the other, or a dispute over an activity or a haircut. These are real issues and they belong in a regular motion, an expedited hearing request, or a motion for contempt and enforcement — not in an emergency filing.
Ex parte relief and how short it lasts
Ex parte means the judge acts on one side's sworn filing before the other parent has been heard. Florida courts grant it only where giving notice first would itself defeat the purpose — for example, where notice would prompt an immediate flight with the child. Any ex parte order is temporary. Due process requires a prompt hearing where the other parent can respond, typically within days, and the temporary order stands or falls on the evidence at that hearing.
Child pick-up orders
Where a child is being wrongfully withheld or has been taken, a court can enter an order directing law enforcement to assist in returning the child to the parent entitled to timesharing. These orders are specific: they name the child, the address, the person who must surrender the child and the officer's role. Law enforcement enforces the order as written, which is exactly why the drafting has to be precise.
Domestic violence injunctions run on a separate track
A petition for an injunction for protection against domestic violence under section 741.30 is its own case, filed with the clerk at no cost, and it moves fast: a judge reviews it the same or next business day and can enter a temporary injunction lasting up to 15 days, with a full hearing set inside that window. A temporary injunction can award temporary exclusive use of the home and temporary support and timesharing provisions. It is often the faster route when the underlying facts involve violence.
What the judge needs to see
Emergency motions succeed or fail on specificity. Dates, times, places, what was said, what was observed, who else saw it, and what documents or messages support it. Attach what you have. A verified motion built on first-hand facts is treated very differently from one built on what someone heard. Because the filing is sworn, exaggeration in it is not a small problem — it is grounds for the court to disbelieve everything that follows.
If it is not an emergency, what then
The alternatives move faster than most people expect. A motion for temporary relief can set timesharing, support and use of the home while the case is pending. A motion for contempt and enforcement addresses a parent violating an existing order, and can carry make-up timesharing, fees and sanctions. Many Florida circuits also allow a request for an expedited or shortened-time hearing where the matter is urgent but not an emergency.
Real-World Scenarios
The other parent did not return the child after their weekend
A single late return is normally an enforcement matter, not an emergency. A pattern of withholding, or a refusal combined with signs of leaving the area, changes the analysis and can support emergency relief and a pick-up order.
You believe your child is about to be taken out of the country
This is one of the clearest emergencies. Courts look for concrete indicators — a passport application, tickets, a sold vehicle, a resignation, statements to third parties — and can order surrender of passports and place travel restrictions along with temporary custody provisions.
A parent is using drugs while the children are in their care
Sworn, first-hand facts about supervision and safety right now can support emergency relief. Courts commonly respond with temporary supervised timesharing and testing rather than a permanent change, then revisit at the full hearing.
